Agreement to These Terms. These Terms of Use (“Terms” or “Agreement”) govern your use of the Site, online services, communications, and, where incorporated into or accepted in connection with appointments, Sparkle Grooming Corp. and its affiliates, subsidiaries, successors, and assigns (collectively, “Sparkle”) grooming and related pet care services. We refer to these websites, applications, and services collectively as the “Services.” By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Changes to These Terms. We may update these Terms by posting a revised version on Sparkle’s websites or mobile applications (collectively, the “Site”). The revised Terms apply when posted unless we state otherwise. If you continue to use the Services after revised Terms take effect, you accept the changes. A Dispute that arose before revised Terms took effect will remain governed by the version in effect when the Dispute arose, including its binding individual arbitration provision.

Terms Governing Use of the Site and Services

Age Requirement. You must be at least 18 years old to use the Site or Services.

Lawful Use. You may use the Site and Services only for lawful purposes and in compliance with these Terms.

Privacy. Our Online Privacy Policy explains how Sparkle collects, uses, and discloses personal information.

Accounts, Suspension, and Termination. Some features may require you to create an account and provide information such as your email address and password (your “Credentials”). You must provide accurate, complete, and current information and promptly update it when necessary. You are responsible for activity under your account and for keeping your Credentials confidential. If you believe someone has used your Credentials without permission, notify us immediately at help@sparkledogcare.com. To the extent permitted by applicable law, Sparkle may suspend, restrict, or terminate your account or access to any Site or Service, with or without prior notice, if Sparkle reasonably believes that you have misused the Site or Services, engaged in fraud or attempted fraud, made threats or engaged in abusive or unsafe conduct, failed to pay amounts when due, created or contributed to a security concern, violated these Terms or applicable law, or if suspension or termination is reasonably necessary to protect Sparkle, its customers, personnel, service providers, or others. Upon suspension or termination, your right to access and use the affected account, Site, or Services will immediately cease or be limited as directed by Sparkle. Suspension or termination does not relieve you of payment obligations incurred before the effective date, affect rights or remedies that accrued before that date, or require Sparkle to retain or provide access to account content except as required by law. Provisions that by their nature should survive will remain effective in accordance with the Survival provision below.

Purchases and Payments. If you purchase a product or service through the Site (a “Transaction”), Sparkle or the applicable third-party provider may request payment, shipping, and other information needed to complete the Transaction. Sparkle handles personal information as described in our Online Privacy Policy and may provide relevant information to service providers involved in processing or fulfilling your Transaction. You authorize Sparkle and those providers to charge your selected payment method for the purchase price, shipping and handling charges, and applicable taxes. You represent that you are authorized to use the payment method you provide.

Product and service descriptions, images, and links do not constitute Sparkle’s endorsement of a third-party offering. We may correct errors, change descriptions or prices, limit quantities, require additional verification, or refuse or cancel an order where permitted by law. Prices and availability may change without notice. Refunds and exchanges are governed by the policies that apply to the Transaction at the time of purchase. For current pricing, email help@sparkledogcare.com.

Pet and Grooming Services

Pet Information. You agree to provide accurate, complete, and current information about your pet that may be relevant to the safe provision of services, including health conditions, allergies, medications, physical limitations, behavioral concerns, bite history, vaccination status, and veterinary contact information.

Authority to Request Services. You represent that you own the pet for whom you request services or are authorized by the owner to request services, provide information about the pet, and make decisions concerning the pet.

Grooming Services Agreement. Additional terms presented when you book or receive grooming services are incorporated into your agreement with Sparkle. If those terms conflict with these Terms regarding the grooming service, the service-specific terms control.

Pet Information and Privacy. Information about a pet, including health, medication, veterinary, insurance, genetic, behavioral, and grooming information, relates to the animal and is not human medical information. When pet information is linked to you or your household, Sparkle handles it as described in our Online Privacy Policy.

No Veterinary Services or Advice. Sparkle provides grooming and routine pet-care services. Sparkle does not provide veterinary diagnosis, treatment, or medical advice. Information provided through the Site, Services, or Sparkle communications is general information and is not a substitute for advice or care from a licensed veterinarian.

Pet Emergencies. Do not use the Site or Services to request emergency veterinary assistance. If you believe a pet is experiencing a medical emergency, contact a licensed veterinarian or emergency veterinary facility immediately. Sparkle does not continuously monitor website, email, chat, or text communications and cannot guarantee an immediate response.

Safety and Pet Behavior. Sparkle may decline, suspend, modify, or stop a service if a pet’s health, condition, behavior, or other circumstances create a safety concern for the pet, Sparkle personnel, or others. Additional requirements governing handling, matting, service interruption, owner pickup, and related matters may be included in the grooming-service agreement or authorization applicable to the service.

Veterinary Contact During Services. If Sparkle reasonably believes that a pet needs prompt veterinary attention while in Sparkle’s care, Sparkle may attempt to contact you and the veterinarian identified in the pet’s records. If you cannot be reached, Sparkle may seek or arrange reasonably necessary veterinary care when permitted by the grooming-service agreement or other authorization applicable to the service. You are responsible for resulting veterinary, transportation, and related charges except to the extent applicable law or a written agreement provides otherwise.

Pet Photographs and Service Records. Sparkle may create photographs and records to document a pet’s condition, customer instructions, services performed, and service-related incidents. These operational photographs and records are neither User Content nor Tagged Content and are handled as described in our Online Privacy Policy. Sparkle will use a pet photograph for advertising or other promotional purposes only as authorized by the pet owner or the pet owner’s authorized representative.

Communications and Social Interactions

Communications. Where permitted by law, Sparkle may record, monitor, transcribe, summarize, or analyze calls, texts, chats, grooming consultations, and customer-service interactions for service, safety, training, quality-assurance, recordkeeping, and dispute-resolution purposes. Additional information is provided in our Online Privacy Policy. When applicable law requires additional consent, Sparkle will request it at the time of the communication.

Social Media and Online Communities. Sparkle may allow you to participate in discussion boards, chats, or other online communities that Sparkle operates or controls (“Sparkle Communities”). Sparkle may also maintain accounts or pages on third-party social-media platforms (“Social Media Sites”). Your use of a Social Media Site is governed by that platform’s terms and policies as well as any applicable provisions of these Terms. You must respect others’ rights and privacy and may not submit photographs or personal information about another person without permission.

User Content. “User Content” means content, postings, photographs, and other materials that you submit directly to a Sparkle Community or through another feature of the Site that allows user submissions. User Content does not include Tagged Content or operational photographs and service records created by Sparkle. You retain any ownership rights you have in your User Content. You provide User Content voluntarily, on a non-confidential basis, and without compensation. You grant Sparkle a perpetual, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, distribute, display, perform, modify, adapt, publish, and create derivative works from your User Content in any form or format in connection with Sparkle’s business.

You represent and warrant that you own your User Content or have all rights and permissions necessary to submit it and grant the license above, and that your User Content truthfully reflects your own experience. You may not submit User Content that: (a) is unlawful, false, defamatory, obscene, indecent, abusive, threatening, harassing, discriminatory, or hateful; (b) infringes or violates any copyright, trademark, trade secret, privacy, publicity, moral, personal, or other right; (c) includes another person’s image or personal information without permission; (d) contains malicious code, viruses, or other harmful material; (e) impersonates another person; or (f) advertises or solicits products or services, distributes chain letters or bulk messages, or collects contact information for unsolicited communications. User Content posted in public or group areas may be viewed, copied, or used by others, and Sparkle cannot control those uses. Sparkle may remove User Content or terminate or restrict access to a Sparkle Community at any time but has no obligation to monitor User Content.

Tagged Content. “Tagged Content” means content that you post on a Social Media Site using a Sparkle-designated hashtag, tagging, or mentioning a Sparkle account, or otherwise identifying the content for possible use by Sparkle. Tagged Content is not User Content. You retain any ownership rights you have in your Tagged Content. By identifying content for possible use by Sparkle, you grant Sparkle a perpetual, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, distribute, display, perform, modify, adapt, publish, and create derivative works from that Tagged Content in any form or format in connection with Sparkle’s business. You represent and warrant that you own the Tagged Content or have all rights and permissions necessary to grant this license and that the Tagged Content complies with these Terms, applicable law, and the rules of the Social Media Site. Sparkle may choose, but is not required, to display Tagged Content on the Site. To request removal of Tagged Content displayed by Sparkle, email help@sparkledogcare.com. Making the original post private or deleting it from the Social Media Site may not automatically remove a copy previously displayed by Sparkle.

Moderation. Sparkle is not required to monitor User Content in Sparkle Communities or Tagged Content on Social Media Sites. We may review, edit, remove, decline to display, or disclose User Content or Tagged Content when reasonably necessary to operate the Site, enforce these Terms, protect Sparkle or others, or comply with law or a governmental request. Sparkle’s ability to remove Tagged Content is limited to copies displayed on websites, accounts, or services that Sparkle controls.

Copyright Notice. This Site is owned and operated by Sparkle. The entire contents and design of the site are protected by U.S. and international copyright law. All rights regarding the Site and materials contained on the Site are either owned by Sparkle, are licensed to it, or are used with permission. Sparkle and its licensors retain and reserve all proprietary rights to the contents of this Site.

Unless Sparkle gives you prior written permission, you may not copy, republish, upload, post, display, transmit, frame, or commercially use materials from the Site. You may view, download, display, or print one copy for your personal, noncommercial, and informational use if you: (1) do not alter the materials; (2) retain all copyright, trademark, and other notices; and (3) do not suggest that Sparkle sponsors or endorses you or your use. Each preapproved use or copy must include: “Copyright © 2026 Sparkle. All rights reserved.” Sparkle may revoke this limited permission at any time. It ends automatically if you breach these Terms. When it ends, you must stop using the materials and destroy or return all copies in your possession or control.

Copyright Infringement Notice. If you believe that material on the Site infringes a copyright you own or are authorized to enforce, you may submit a notice under the Digital Millennium Copyright Act (“DMCA”) asking Sparkle to remove or disable access to the material. Send the notice to Sparkle Grooming Cor, 4250 N. Drinkwater Blvd., Ste. 165, Scottsdale, AZ 85251. The notice must include the following information: (a) a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the material that is claimed to be infringing or the subject of infringing activity; (d) the name, address, telephone number, and email address of the complaining party; (e) a statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law; and (f) a statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. If you believe in good faith that a notice of copyright infringement has been wrongly filed against you, the DMCA permits you to send us a counter-notice. Notices and counter-notices must meet the then-current statutory requirements imposed by the DMCA. Notices and counternotices with respect to the Site should be sent to the address above.

Trademark Notice. Sparkle’s names and logos and all related product and service names, design marks, and slogans are trademarks or service marks of Sparkle. All rights are reserved. You are not authorized to use any Sparkle name or mark in any advertisement, publicity, or other commercial manner without Sparkle’s prior written consent. All other trademarks appearing on the Site are the property of their respective owners.

Security. Sparkle uses appropriate safeguards to protect personal information against accidental loss and unauthorized access, use, alteration, or disclosure. No security measure is perfect, however, and we cannot guarantee that information will remain secure in every circumstance.

SMS and Mobile Messaging Terms and Conditions

About Sparkle Alerts. Sparkle Alerts (the “Messaging Program”) is a recurring text-message program that may provide appointment reminders, scheduling and service updates, account notifications, customer-service communications, health and grooming tips, discounts, special offers, promotions, and other messages you authorize. “You” means the person who enrolls in or uses the Messaging Program, and “we,” “us,” and “our” mean Sparkle and any service provider acting on Sparkle’s behalf.

Enrollment and Consent. You may enroll in Sparkle Alerts through an enrollment method made available by Sparkle. After you submit your mobile telephone number (“Your Mobile Number”), you will receive a text message asking you to confirm your consent to receive text messages at Your Mobile Number. By enrolling, you certify that you are at least 18 years old and that you are the account holder for Your Mobile Number or have the account holder’s permission to enroll. You agree not to enroll any other person’s or entity’s mobile number. No purchase is necessary to participate. The Messaging Program is available only in the United States.

Acceptance and Changes. By enrolling in or using the Messaging Program, you agree to the Terms. If you do not agree, you must stop using the Messaging Program and opt out as described below. We may update the Terms by posting the revised terms on the Site and may also notify you by text message at Your Mobile Number. Your continued use of the Messaging Program after the revised terms are posted constitutes your acceptance of the revised terms.

Message Frequency and Charges. Sparkle expects to send approximately five (5) automated text messages per month. Sparkle does not charge for Sparkle Alerts, but message and data rates may apply under your wireless plan. Your carrier may charge you for messages sent or received in connection with the Messaging Program.

Opt Out and Opt Back In. You may stop receiving Sparkle Alerts at any time by replying STOP to a Sparkle Alerts message or emailing help@sparkledogcare.com. You will receive confirmation of your opt-out and will no longer receive Sparkle Alerts at Your Mobile Number unless you enroll again. To opt back in, use an enrollment method made available by Sparkle and follow the enrollment instructions.

Help and Contact Information. For help, email help@sparkledogcare.com.

Participating Carriers and Delivery. The Messaging Program is available through many wireless carriers but is not compatible with every carrier, device, or service plan. Sparkle and participating carriers are not responsible for delayed or undelivered messages. Delivery is subject to effective transmission by your network operator and circumstances beyond our control.

Your Mobile Number and Account Information. You agree to maintain accurate, complete, and current information concerning your use of the Messaging Program. You must notify us promptly if you cease to be the subscriber or regular user of Your Mobile Number.

Privacy Policy. Our collection, use, and disclosure of information in connection with the Messaging Program are described in our Online Privacy Policy.

Dispute Resolution. Any dispute arising out of or relating to the Messaging Program is governed by the Disputes, Binding Individual Arbitration, and Limitation on Time to Initiate a Dispute provisions of this Agreement.

The Disclaimer of Warranties, Limitation of Liability, and Governing Law provisions of this Agreement apply to the Messaging Program.

Notice for California Users. If you have a question or complaint regarding the Messaging Program, contact us at help@sparkledogcare.com. You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by telephone at (800) 952-5210 or TDD (800) 326-2297, or in writing at Department of Consumer Affairs, Consumer Information Division, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834.

Additional Legal Terms

Your Representations. You represent that you are legally able to agree to these Terms and that you will use the Site and Services in compliance with these Terms and applicable law.

Disclaimer of Warranties. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU USE THE SITE AND SERVICES AT YOUR OWN RISK. THEY ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SPARKLE AND ITS PROCESSORS, PROVIDERS, LICENSORS, AFFILIATES, AGENTS, DIRECTORS, AND EMPLOYEES DO NOT WARRANT THAT THE SITE OR SERVICES WILL BE ACCURATE, RELIABLE, COMPLETE, SECURE, UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL CODE; THAT DEFECTS WILL BE CORRECTED; OR THAT THEY WILL MEET YOUR REQUIREMENTS. INFORMATION OR ADVICE OBTAINED THROUGH THE SITE DOES NOT CREATE A WARRANTY. YOU ARE RESPONSIBLE FOR ANY DAMAGE OR DATA LOSS RESULTING FROM MATERIAL YOU DOWNLOAD OR OTHERWISE OBTAIN THROUGH THE SITE.

SPARKLE DOES NOT WARRANT, ENDORSE, OR GUARANTEE PRODUCTS OR SERVICES OFFERED BY THIRD PARTIES THROUGH THE SITE, A LINKED WEBSITE, OR ADVERTISING. SPARKLE IS NOT A PARTY TO, AND HAS NO RESPONSIBILITY FOR, TRANSACTIONS BETWEEN YOU AND A THIRD-PARTY PROVIDER.

Indemnification. To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Sparkle and its affiliates, and their respective officers, directors, employees, contractors, agents, and representatives (collectively, the “Sparkle Parties”), from and against third-party claims, actions, demands, liabilities, judgments, settlements, losses, damages, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to: (a) your breach of this Agreement; (b) your unlawful or improper use of the Site or Services; (c) your User Content or Tagged Content, including any allegation that it infringes, misappropriates, or violates another person’s rights; or (d) your fraud, willful misconduct, or violation of applicable law. Sparkle may assume control of the defense and settlement of any indemnified claim. You may not settle an indemnified claim in a manner that imposes liability, obligations, admissions, or restrictions on any Sparkle Party without Sparkle’s prior written consent.

Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOUR SOLE REMEDY IF YOU ARE DISSATISFIED WITH THE SITE OR A SERVICE IS TO STOP USING IT. THE SPARKLE PARTIES WILL NOT BE LIABLE FOR LOSSES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SITE, SERVICES, OR SITE MATERIALS, REGARDLESS OF THE LEGAL THEORY ASSERTED. THIS LIMITATION APPLIES TO DIRECT, INDIRECT, SPECIAL, INCIDENTAL, RELIANCE, CONSEQUENTIAL, EXEMPLARY, AND PUNITIVE DAMAGES; PERSONAL INJURY OR WRONGFUL DEATH; LOST PROFITS OR DATA; AND BUSINESS INTERRUPTION.

Disputes. If a dispute of any kind arises, we want to understand and address your concerns quickly and to your satisfaction. Please contact us at help@sparkledogcare.com regarding any dispute. If we cannot resolve your concerns, you and Sparkle agree to the informal and individual dispute-resolution process described below. For purposes of these Terms, a “Dispute” means any claim, controversy, or dispute between you and Sparkle or its processors, suppliers, licensors, affiliates, agents, directors, or employees, whether based in contract, tort, equity, statute, or another legal theory, including any claim relating to these Terms, their breach, termination, or interpretation, any other aspect of our relationship, Sparkle advertising, or your use of the Site or Services.

Binding Individual Arbitration. You and Sparkle agree to arbitrate all Disputes, including Disputes arising out of or relating to the Messaging Program and claims under the Telephone Consumer Protection Act, 47 U.S.C. § 227 et seq. Arbitration is more informal than a lawsuit in court and is intended to resolve disputes more efficiently. Instead of a judge or jury, a neutral arbitrator will decide the case and may award the same damages and relief available in court. ANY ARBITRATION UNDER THIS AGREEMENT WILL PROCEED ONLY ON AN INDIVIDUAL BASIS. CLASS ARBITRATIONS, CLASS ACTIONS, PRIVATE ATTORNEY GENERAL ACTIONS, REPRESENTATIVE OR COLLECTIVE PROCEEDINGS, AND CONSOLIDATION WITH OTHER ARBITRATIONS ARE NOT PERMITTED. YOU AND SPARKLE WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS, REPRESENTATIVE, OR COLLECTIVE ACTION OR ARBITRATION. If any provision of this arbitration agreement is found unenforceable, that provision will be severed and the remaining arbitration terms will be enforced, but in no event will there be class arbitration. All Disputes will be resolved finally and exclusively by binding individual arbitration before a single arbitrator administered by the American Arbitration Association under its applicable rules. Consumer claimants whose transaction is intended for personal, family, or household use may elect to pursue an eligible individual claim in their local small-claims court instead of arbitration. The Federal Arbitration Act, 9 U.S.C. §§ 1–16, governs this arbitration agreement. If you are a consumer bringing a claim relating to personal, household, or family use, any arbitration hearing will occur in the county or parish where you reside. Otherwise, any arbitration hearing will occur in Scottsdale, Arizona, another location mutually agreed upon in writing, or a location ordered by the arbitrator. The arbitrator’s award will be binding and may be entered as a judgment in any court of competent jurisdiction. If you prevail on a claim for which applicable law authorizes attorneys’ fees, the arbitrator may award those fees. Sparkle will not seek recovery of its attorneys’ fees from you unless the arbitrator determines that your claim was frivolous. References to “you” and “Sparkle” in this arbitration provision include their respective subsidiaries, affiliates, agents, employees, predecessors, successors, and assigns. Subject to and without waiver of the arbitration provisions above, any judicial proceeding other than an eligible individual small-claims action must be brought in the state courts located in Maricopa County, Arizona, or the United States District Court for the District of Arizona, and you consent to the exclusive jurisdiction and venue of those courts.

Governing Law. Arizona law governs this Agreement, without regard to conflict-of-law principles, except to the extent that federal law or nonwaivable law in your state applies. The arbitration and venue provisions above govern how and where Disputes must be resolved.

Requests for Information. If you ask us for information about Sparkle’s programs or services, we may use the contact information you provide to respond. We handle that information as described in our Online Privacy Policy.

Limitation on Time to Initiate a Dispute. Unless otherwise required by law, an action or proceeding by you relating to any Dispute must commence within one (1) year after the cause of action accrues.

Links to Other Websites. Sparkle’s Site may contain links to third-party websites as a convenience to you. The inclusion of any website link does not imply Sparkle’s approval, endorsement, or recommendation. You agree that you access any such website at your own risk and that the website is not governed by these Terms. Sparkle expressly disclaims any liability for third-party websites. When you use a link to leave our Site, our Online Privacy Policy no longer applies. Your browsing and interaction on another website, including one linked from our Site, are subject to that website’s own terms and policies.

Downloadable Files and Email. Sparkle cannot and does not guarantee or warrant that email or files available for downloading from its Site will be free of viruses or other code that may contaminate or destroy data on your computer. You are responsible for implementing appropriate protective procedures and maintaining backup copies sufficient to reconstruct any lost or corrupted data. Sparkle does not assume any responsibility or risk for damage to your computer or its files related to your use of the Services.

Other Provisions. This Agreement constitutes the entire agreement between you and Sparkle concerning its subject matter and supersedes any inconsistent or conflicting statement on the Site. If this Agreement conflicts with another written agreement between you and Sparkle concerning the same subject matter, the more specific agreement will control to the extent of the conflict unless it states otherwise. This Agreement may be modified only as described in this Agreement. If any provision is held invalid or unenforceable, it will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect. Headings are for convenience only and do not affect interpretation. Sparkle’s failure to enforce any right or provision is not a waiver of that right or provision, and no waiver will constitute a continuing waiver or a waiver of any other term. Nothing in this Agreement limits any rights Sparkle may have under trade secret, copyright, patent, trademark, or other applicable law.

Assignment. You may not assign any rights or obligations under this Agreement without Sparkle’s prior written consent. Sparkle may assign all or part of this Agreement.

Survival. Provisions that by their nature should remain effective after this Agreement ends will survive, including provisions concerning intellectual property, User Content and Tagged Content licenses, indemnification, warranty disclaimers, limitations of liability, dispute resolution, and governing law.

Notices. You agree that we may provide any and all notices to you by e-mail, text message, website posting on the Site, telephone, or any other method permitted by applicable law.

Contact Information. Please contact us with any questions or concerns regarding this Agreement at: help@sparkledogcare.com
